Authorship and Ownership Dispute – Public Notice

This notice is issued as an official statement from Sheryl “Sherry” Carr, regarding the ongoing legal status of certain sculptural works previously developed in collaboration with Fabrizio Sburlati (also known as “Fabrizio Esse”).

OVERVIEW

Active state and federal proceedings are addressing questions of authorship, ownership, and derivative rights concerning sculptural works developed between the parties.

Until these matters are resolved, any claim or representation that upcoming or recently announced models are solely the original work of Mr. Sburlati may constitute a false designation of origin and misrepresentation under 15 U.S.C. § 1125(a) (Lanham Act).

In addition, criminal complaints have been filed, in both Italy and the USA, addressing acts of defamation, cybercrime, and other unlawful online conduct that are distinct from the authorship dispute itself.

CURRENT STATUS

Until these matters are fully resolved, any representation that new or upcoming models associated with Mr. Sburlati are entirely his sole creation or authorship is legally disputed.

No authorization has been granted for the release, reproduction, or sale of any work derived from, based upon, or materially connected to the collaborative designs developed during the partnership.

PURPOSE OF THIS NOTICE

Distributors, collectors, and sales platforms are respectfully notified that works derived from or based upon designs produced during the collaborative period remain in legal dispute.

Any sale, advertisement, or reproduction of these disputed works should clearly disclose that authorship is contested and refrain from attributing exclusive authorship to either party pending court determination.

This statement is issued solely to:

  • Prevent public confusion regarding the origin and authorship of the affected works;

  • Preserve the integrity of ongoing legal processes; and

  • Ensure that collectors, distributors, and members of the public are properly informed and not misled before engaging in transactions involving disputed materials.
